A Temporary Operating Permit — TOP — is a document that allows a vehicle to be operated on California roads for a limited time while registration or title issues are being resolved. Dealers may issue TOPs in certain circumstances, such as when the electronic system is down and a TLP can’t be generated, or when a vehicle needs to be moved to a smog station or repair facility for work needed to complete the sale.
A TOP is not a substitute for proper registration or a TLP. It’s a temporary measure for specific situations with a defined expiration date. Using TOPs routinely instead of properly processing sales through the electronic ROS/TLP system is a red flag for DMV and can lead to enforcement action.
When issuing a TOP, complete it accurately, specify the reason for the permit, and note the expiration date clearly. Keep a copy in your records. Don’t issue TOPs as a favor to anyone — each TOP must have a legitimate basis.
