DMV has the authority to waive certain fees and penalties under specific circumstances. The REG 94 — Waiver of Fees and/or Penalties — is the form used to request a waiver. Waivers may be granted when penalties were incurred due to circumstances beyond the applicant’s control, such as military deployment, hospitalization, natural disaster, or DMV processing errors.
As a dealer, you may need to request a waiver on behalf of a customer — for example, if DMV processing delays caused late registration penalties, or if a transfer was delayed due to a DMV system error. When requesting a waiver, provide documentation supporting the reason for the request. The more complete your documentation, the more likely the waiver will be granted.
Be honest in waiver requests. A waiver request that misstates the facts — for example, claiming DMV caused a delay when the delay was actually your fault — can backfire. DMV can verify the facts, and submitting a fraudulent waiver request is worse than paying the penalty.
